Las personas naturales o jurídicas, públicas o privadas, que deseen generar energía hidráulica, cinética o eléctrica, deberán solicitar concesión o proponer asociación. Para la concesión o la asociación se deberán tener en cuenta los indispensables factores de índole ecológica, económica y social.
