Siempre que aparezca comprobado que un procesado, al tiempo de cometer el hecho o al tiempo del proceso, se encuentra en estado de enajenación mental, o de intoxicación crónica producida por el alcohol o por cualquiera otra sustancia venenosa o que padece de cualquiera otra grave anomalía psíquica, será detenido preventivamente en un manicomio criminal o en una colonia agrícola especial para anormales.
