CONFIRMAR los numerales primero, segundo y cuarto del fallo proferido por el JUZGADO DE FAMILIA DE CALARCÁ, QUINDÍO, el 31 de agosto de 2009, dentro de la acción de tutela promovida por CARLOS ALBERTO GRISALES BENJUMEA contra el el INSTITUTO NACIONAL PENITENCIARIO Y CARCELARIO “INPEC”, el DIRECTOR REGIONAL VIEJO CALDAS INPEC y el DIRECTOR DEL ESTABLECIMIENTO PENITENCIARIO Y CARCELARIO “PEÑAS BLANCAS” DE CALARCÁ. Segundo. MODIFICAR el numeral tercero del fallo objeto de impugnación en el siguiente sentido: - NEGAR POR IMPROCEDENTE el amparo de los restantes derechos fundamentales incoados por el señor CARLOS ALBERTO GRISALES BENJUMEA contra el INSTITUTO NACIONAL PENITENCIARIO Y CARCELARIO “INPEC”, el DIRECTOR REGIONAL VIEJO CALDAS INPEC y el DIRECTOR DEL ESTABLECIMIENTO PENITENCIARIO Y CARCELARIO “PEÑAS BLANCAS” DE CALARCÁ.
