- Primero. REVOCAR el fallo de instancia dictado el 19 de diciembre de 2000 por el Juzgado
- Segundo. Penal del Circuito de Guadalajara de Buga, Valle, para en su lugar CONCEDER la tutela respecto del derecho fundamental al debido proceso a los accionantes JAIR BERMÚDEZ QUIÑÓNEZ y WILLIAM FERNANDO BECERRA POSSO.
- Segundo. DEJAR sin efecto alguno la Resolución No. 126, fechada el "5 de diciembre de 2000", dictada por el Director de la Cárcel del Distrito Judicial de Guadalajara de Buga, Valle, mediante la cual falló el proceso administrativo disciplinario adelantado contra los accionantes, referenciado en el cuerpo de la presente sentencia.
- Tercero. ORDENAR, en consecuencia, al Director del mencionado establecimiento carcelario que deje a disposición del CONSEJO DE DISCIPLINA respectivo, el expediente administrativo disciplinario que se adelantó contra los accionantes JAIR BERMÚDEZ QUIÑÓNEZ y WILLIAM FERNANDO BECERRA POSSO, y los internos JORGE ELIÉCER MARIN, LUIS EDUARDO LOPEZ COPAKAN, ELKIN DARIO BOLAÑOS, LUIS FERNANDO BONILLA RIVERA y DANNY PULGARIN SERNA, para que dicho Consejo dicte oportunamente el acto administrativo que corresponda, sin perjuicio de que se practiquen previamente las pruebas que se consideren necesarias y las que llegaren a solicitar los internos disciplinados. El Consejo de Disciplina deberá igualmente observar que se cumpla el procedimiento legal a cabalidad, previsto en los artículos 133 y siguientes de la Ley 65 de 1993, de todo lo cual deberá informar al Juzgado
- Segundo. Penal del Circuito de Guadalajara de Buga en su debida oportunidad.
- Cuarto. ORDENAR que por Secretaría General se dé cumplimiento a lo previsto en el artículo 36 del decreto 2591 de 1991.
