- Primero. LEVANTAR la suspensión del término decretada para decidir el presente asunto.
- Segundo. CONFIRMAR la sentencia de 28 de enero de 2004 proferida por la Sala de Casación Penal de la Corte Suprema de Justicia, que revocó la sentencia de 28 de noviembre de 2003 de la Sala Penal del Tribunal Superior del Distrito Judicial de Bogotá, y en su lugar concedió la tutela instaurada por el señor Dionisio Correa Maza, de conformidad con lo dispuesto en la parte motiva de ésta providencia.
- Tercero. Por secretaría General líbrese la comunicación prevista en el artículo 36 del Decreto 2591 de 1991.
