El accionante actúa como agente oficioso de su madre quien tiene 83 años de edad y sufrió un infarto en enero de 2009, la EPS a la cual esta afiliada la señora señaló que no cubriría el costo de la atención médica, por no reunir el número de semanas mínimas de cotización, el actor explicó que en el año 2008 por el pago de los aportes en seguridad social mediante planilla única se presentaron inconvenientes para realizar los pagos correspondientes por parte de su empleador y por esta razón perdió la antigüedad.
La Sala encuentra que la pretensión que motivó la acción ha sido satisfecha y se está en presencia de un hecho superado.

CONFIRMAR, por tratarse de hecho superado, el fallo dictado en mayo 4 de 2009 por el Juzgado Treinta y Nueve Civil del Circuito de Bogota, mediante el cual fue confirmado el proferido por el Juzgado Veintiseis Civil Municipal de Bogota en febrero 17 del mismo ano, dentro de la accion de tutela instaurada por Carlos Arturo Pedreros Manjarres actuando como agente oficioso de su progenitora Escilda Manjarres Guevara, contra Sanitas EPS.
