  1. Primero. CONFIRMAR las sentencias proferidas por la Sala de Casacion Penal de la Corte Suprema de Justicia el 12 de mayo de 1998 y el 9 de junio del mismo ano, por medio de las cuales se nego por improcedente la tutela de los derechos reclamados por Myriam Barrera Fajardo.
  2. Segundo. ORDENAR que, por medio de la Secretaria General de esta Corporacion, se remita copia de esta providencia y de la actuacion surtida a la Fiscalia General de la Nacion averigue si la actora, su apoderado civil, Janeth Patricia Rios Rios y Jose Maria Vargas Alvarez violaron la ley penal con ocasion del proceso civil en el que se originaron las dos acciones aqui revisadas.
  3. Tercero. CONDENAR en costas a Myriam Barrera Fajardo por haber incurrido en temeridad al instaurar la accion de tutela radicada bajo el numero T-170.834.
  4. Cuarto. COMUNICAR esta sentencia al Tribunal Superior del Distrito Judicial de Santafe de Bogota -Sala Penal-, para los efectos previstos en el articulo 36 del Decreto 2591 de 1991.
