  1. Primero. REVOCANSE en todas sus partes las providencias proferidas en este caso por los jueces de instancia.
  2. Segundo. CONCEDESE la tutela impetrada, para proteger el mínimo vital del accionante y su familia, y, en consecuencia, ordénase al Ministerio de Defensa Nacional que, si ya no lo hubiere hecho, proceda, dentro de las cuarenta y ocho (48) horas siguientes a la notificación del presente fallo, al pago de las prestaciones reclamadas por el actor y a él ya reconocidas, junto con la indexación correspondiente.
  3. Si, por la imprevisión administrativa, no hubiere partida presupuestal disponible, las cuarenta y ocho (48) horas se conceden para que el Ministro de la Defensa Nacional inicie los trámites correspondientes para las adiciones que permitan el pago. Notifíqueselo personalmente de esta providencia.
  4. Tercero. DESE traslado a la Procuraduría General de la Nación para que investigue las razones de la injustificada demora que ha dado lugar a la tutela concedida.
  5. Cuarto. LIBRESE la comunicación prevista en el artículo 36 del Decreto 2591 de 1991.
