- PRIMERO. Confirmar la sentencia del Consejo de Estado del veinticinco (25) de mayo del presente ano, que deniega la tutela impetrada por Martha Lucia Garcia Velasquez, salvo en lo referente a la pretension B) de la demanda de tutela, por las razones expuestas en la parte motiva de esta providencia.
- SEGUNDO. Conceder la tutela impetrada y en consecuencia, ordenar que se suspenda el proceso ejecutivo de jurisdiccion coactiva que adelanta el Municipio de Cali en contra de la actora, hasta que se produzca una decision en firme, de autoridad competente, que clara y expresamente resuelva, en favor de la senorita Martha Lucia Garcia Velasquez, el conflicto de derechos planteado sobre el predio identificado en este expediente.
- TERCERO. Comunicar esta providencia al Honorable Tribunal Contencioso Administrativo del Valle del Cauca, Seccion Primera, para los efectos del articulo 36 del Decreto 2591 de 1991.
