- Primero. REVOCAR la sentencia proferida por el Juzgado Catorce Civil del Circuito de Barranquilla el diecinueve (19) de diciembre de 2001 en la que se decidió no tutelar el derecho al debido proceso del accionante.
- Segundo. CONCEDER la tutela de la referencia. En consecuencia ORDENAR a la Sociedad de Acueducto, Alcantarillado y Aseo de Barranquilla S.A. que en el término de cuarenta y ocho (48) horas siguientes a la notificación del fallo, traslade el expediente a la Superintendencia de Servicios Públicos Domiciliarios para que se resuelva el recurso de apelación interpuesto.
- Tercero. Por Secretaría, líbrese la comunicación prevista en el artículo 36 del Decreto 2591 de 1991.
