- Primero. REVOCAR la sentencia proferida el veintiuno (21) de abril de 1998 por el Juzgado 75 Penal Municipal de Santafe de Bogota D.C.
- Segundo. en su lugar, TUTELAR el derecho de Peticion del actor, ordenando a la Caja Nacional de Prevision CAJANAL, -Subdireccion de Prestaciones Economicas- que dentro de las cuarenta y ocho (48) horas siguientes a la notificacion del presente fallo, resuelva de fondo, si todavia no lo ha hecho, sobre la solicitud elevada por el actor el 10 de septiembre de 1997.
- Tercero. Dese cumplimiento a lo previsto en el articulo 36 del Decreto 2591 de 1991.
