- PRIMERO. Revocar la sentencia del Juzgado
- Cuarto. Civil Municipal de Barrancabermeja y, en su lugar, conceder la tutela solicitada por los señores Freddy Pérez Vásquez, Miguel Angel Amaya y Omar Cruz por la violación a su libertad de culto.
- SEGUNDO. Ordenar al señor Alcalde Municipal de Barrancabermeja reabrir el Cementerio Central de esa ciudad, dentro de las cuarenta y ocho (48) horas siguientes a la notificación de esta providencia, y permitir que concurran allí quienes deseen, en razón de sus creencias, rendir culto a los muertos, hasta que la Administración Municipal, respetando los derechos de los particulares, complete en legal forma el traslado de los cadáveres que reposan en ese cementerio.
- Advertirle además al señor Alcalde, que en el futuro se abstenga de actuaciones como las que dieron origen a esta acción de tutela, so pena de las sanciones contempladas en el Decreto 2591 de 1991.
- TERCERO. Negar la tutela de los derechos de propiedad y tenencia a título de arriendo, de las bóvedas y criptas del Cementerio Central de Barrancabermeja, por las razones expuestas en la parte motiva de esta providencia.
- CUARTO. Comunicar la presente decisión al Juzgado
- Cuarto. Civil Municipal de Barrancabermeja, para los efectos del artículo 36 del Decreto 2591 de 1991.
