- Primero. CONFIRMAR los fallos proferidos por la Sala Civil del Tribunal Superior del Distrito Judicial y por el Juzgado 24 Civil del Circuito de esta ciudad, pero sólo en cuanto concedieron la tutela incoada por Lucero Reyes Barrero y REVOCARLOS en lo demás.
- En consecuencia, DEJAR SIN EFECTOS toda la actuación adelantada por el Juzgado 41 Civil Municipal de esta ciudad, incluido el auto por medio del cual se admitió la demanda, y ORDENAR al aludido Juzgado 41 Civil Municipal que, en el término de cuarenta y ocho (48) horas, siguientes a la notificación de esta Sentencia, remita el expediente ordinario al Juzgado Civil del Circuito (reparto) de esta ciudad para que éste adelante el proceso respetando las garantías constitucionales y legales.
- Segundo. Por Secretaría, LÍBRESE la comunicación prevista en el artículo 36 del Decreto 2591 de 1991, para los fines allí contemplados.
