- Primero. REVOCANSE los fallos materia de revisión.
- Segundo. CONCEDESE la tutela impetrada por JESUS MARIA LARA SARRIA y, en consecuencia, ORDENASE al liquidador del Instituto Municipal de Reforma Urbana y Vivienda de Cali -INVICALI- y a la Secretaría de Vivienda Social del Municipio de Cali que procedan a devolver, dentro de las cuarenta y ocho (48) horas siguientes a la notificación de este fallo, la suma pagada por el actor a la primera entidad enunciada, por concepto de cuota inicial de una vivienda de interés social dentro del Programa denominado "Colinas de San Miguel de Sur".
- No se condena al pago de intereses ni indemnizaciones, las cuales podrán reclamarse por los procedimientos ordinarios.
- Tercero. REMITASE copia del expediente y de este fallo al Procurador General de la Nación para que investigue las conductas de los servidores públicos que, con sus acciones u omisiones, dieron lugar a los hechos que motivaron la tutela.
- Cuarto. El juez de primera instancia -
- Octavo. Civil del Circuito de Cali- impondrá las pertinentes sanciones por desacato, si esta Sentencia no se cumpliere con exactitud.
- Quinto. DESE cumplimiento a lo previsto en el artículo 36 del Decreto 2591 de 1991.
