- en nombre del pueblo y por mandato de la Constitución Política,
- R E S U E L V E :
- Primero. Revócase la sentencia de fecha 28 de abril de 1994, proferida por el Juzgado Doce Penal del Circuito de Bucaramanga, conforme a lo expuesto en la parte motiva de esta providencia.
- Segundo. Deniégase la solicitud de tutela presentada por el señor Tulio Hermes Castellanos Fernández y en consecuencia queda sin efecto la actuación que haya realizado la Alcaldía Municipal de Floridablanca en cumplimiento del fallo de segunda instancia revocado.
- Tercero. Comunicar el contenido de esta decisión al Juez
- Segundo. Promiscuo Municipal de Floridablanca, el cual notificará la sentencia de esta Corte a las partes y adoptará las decisiones necesarias para adecuar su fallo a lo dispuesto por ésta, de conformidad con el artículo 36 del decreto 2591 de 1991.
