- Primero. REVOCASE la sentencia proferida el 21 de marzo de 1997 por la Juez Veintidós Civil del Circuito de Santa Fe de Bogotá.
- Segundo. CONCEDESE la tutela impetrada por WILFRIDO CUENTAS CASTRO, cuya petición deberá ser resuelta de fondo por la Caja Nacional de Previsión -CAJANAL-, si ya no lo hubiere hecho, a más tardar dentro de las cuarenta y ocho (48) horas siguientes a la notificación de este fallo.
- Tercero. REMITASE copia al Procurador General de la Nación para lo de su competencia.
- Cuarto. DESE cumplimiento a lo previsto en el artículo 36 del Decreto 2591 de 1991.
