- R E S U E L V E
- PRIMERO. REVOCAR las sentencias proferidas por la Sala Plena de lo Contencioso Administrativo del Consejo de Estado del 17 de marzo de 1993 y por la Sección Primera del Tribunal Administrativo de Cundinamarca del 2 de febrero de 1993 y, en su lugar, CONCEDER la tutela solicitada, en razón de lo cual se ORDENA a la ASOCIACION BANCARIA DE COLOMBIA que acredite, dentro del término de cuarenta y ocho horas contados a partir de la notificación de esta providencia, ante el Tribunal Administrativo de Cundinamarca, la eliminación total de los datos del señor CARLOS ENRIQUE GUAQUETA GOMEZ de su central de información. El Tribunal velará por la ejecución de esta sentencia e impondrá las sanciones respectivas en caso de incumplimiento de conformidad con el artículo 53 del Decreto 2591.
- SEGUNDO. LIBRESE comunicación al Tribunal mencionado con miras a que se surta la notificación de esta providencia, según lo establecido en el artículo 36 del Decreto 2591 de 1991.
