- PRIMERO. MODIFICAR la sentencia de diciembre 18 de 1992, proferida por la Sala Penal del Tribunal Superior de Santafé de Bogotá, en el sentido de revocar el numeral 3º de la sentencia de noviembre 27 de 1992, dictada en primera instancia por el Juzgado sesenta y tres Penal del Circuito de Santafé de Bogotá, que condenó a la Corporación de Ahorro y Vivienda, UPAC COLPATRIA S.A. a la indemnización del daño emergente causado al peticionario. En lo demás CONFIRMAR la citada sentencia de segunda instancia.
- SEGUNDO. LIBRESE comunicación al mencionado Tribunal con miras a que se surta la notificación de esta providencia, según lo establecido en el artículo 36 del Decreto 2591 de 1991.
