- PRIMERO. Confirmar la sentencia adoptada por el Honorable Tribunal Superior del Distrito Judicial de Santafé de Bogotá, Sala Penal, el dos (2) de febrero de mil novecientos noventa y cuatro (1994).
- SEGUNDO. Condenar al pago de las costas del presente proceso a la firma demandante, Kasab y Saporitti S. en C., por haber incurrido en temeridad. El Juzgado Cuarenta y Dos Penal del Circuito de Santafé de Bogotá D. C., que actuó como juzgado de primera instancia, procederá con la liquidación de tales costas y con lo que se requiera para dar cabal cumplimiento al artículo 25 del Decreto 2591 de 1991.
- TERCERO. Comunicar la presente providencia al Juzgado Cuarenta y Dos Penal del Circuito de Santafé de Bogotá D.C., para los efectos del artículo 36 del Decreto 2591 de 1991.
