  1. en nombre del pueblo y por mandato de la Constitución,
  2. R E S U E L V E :
  3. PRIMERO. CONFIRMAR la decisión de tutela del 12 de febrero de 1992 proferida por la Sala de Casación Laboral de la Corte Suprema de Justicia.
  4. SEGUNDO. ADICIONAR la mencionada providencia en el sentido de ordenar a la autoridad local correspondiente que en el cumplimiento de la obligación de recuperar el espacio público, en desarrollo del Decreto 742 del 4 de diciembre de 1991, expedido por el Alcalde Municipal de Ibagué, tome las medidas adecuadas, necesarias y suficientes para reubicar a los vendedores ambulantes que se vean afectados por la medida, de modo que con ocasión del ejercicio de la actuación administrativa se arbitre una fórmula que permita la coexistencia de los derechos al espacio público y al trabajo.
  5. TERCERO. LIBRESE por Secretaría las comunicaciones de que trata el artículo 36 del Decreto 2591 para los efectos allí contemplados.
