- Primero. REVOCAR los fallos proferidos por el Juzgado 4 Penal del Circuito de Santiago de Cali y por la Sala Penal del Tribunal Superior de la misma ciudad, mediante los cuales se negó la protección solicitada. En su lugar, se concede la tutela del derecho al trabajo en condiciones dignas y justas.
- En consecuencia, se ORDENA al "Hospital Departamental Siquiátrico Universitario San Isidro, E.S.E" que, dentro de las cuarenta y ocho (48) horas siguientes a la notificación del presente fallo, si no lo hubiere hecho ya, proceda a cancelar la totalidad de los salarios y prestaciones adeudados al demandante siempre y cuando exista partida presupuestal disponible.
- En caso contrario -que debe ser probado ante el juez de primera instancia-, el indicado plazo se concede para iniciar los trámites presupuestales pertinentes, de manera que pague la integridad de las sumas debidas, indexadas, a más tardar en el término de un (1) mes.
- Segundo. DESE cumplimiento a lo previsto en el artículo 36 del Decreto 2591 de 1991.
