- Primero. Revocar lo decidido por el Tribunal Administrativo de Boyaca -Sala Plena- en auto del quince (15) de febrero de mil novecientos noventa y tres (1.993).
- Segundo. Admitir la Accion de Tutela instaurada por Antonio Jose Rodriguez Pineros contra la providencia proferida por la Sala Dual de Familia del Tribunal Superior de Santa Rosa de Viterbo, de fecha treinta (30) de Septiembre de mil novecientos noventa y dos (1.992).
- Tercero. Revocar la providencia proferida por la Sala Dual de Familia del Tribuanal Superior de Santa Rosa de Viterbo de fecha treinta (30) de Septiembre de mil novecientos noventa y dos (1.992).
- Cuarto. En cuanto al incidente resuelto en segunda instancia por la providencia revocada en el ordinal anterior, estese a lo dispuesto por el auto del Juzgado Promiscuo de Familia de Sogamoso y fechado el veinticuatro (24) de abril de mil novecientos noventa y dos (1.992).
- Quinto. No acceder a la peticion tercera de la demanda y por tanto, abstenerse de ordenar la suspension de la diligencia de secuestro del inmueble, puesto que no es competente el juez de tutela para adoptar tal medida.
- Sexto. Librese, por intermedio de la Secretaria General de la Corte, la comunicacion correspondiente al Juzgado Promiscuo de Familia de Sogamoso, para que se le de cumplida aplicacion a lo previsto en el articulo 36 del Decreto 2591 de 1.991.
