- Primero. REVOCAR la sentencia de fecha veintitrés (23) de octubre de mil novecientos noventa y seis (1996), proferida por la Corte Suprema de Justicia. En consecuencia, se concede la tutela solicitada por el señor Nelson Constantino Viscay Quintero contra la Caja Nacional de Previsión.
- Segundo. ORDENAR a la Caja Nacional de Previsión resolver la solicitud de reliquidación de la pensión del demandante en un plazo de cuarenta y ocho (48) horas, contado a partir de la notificación de esta sentencia.
- Tercero. LÍBRENSE, por al Secretaría General de la Corte, las comunicaciones de que trata el artículo 36 del decreto 2591 de 1991, en la forma y para los efectos allí contemplados.
