Derecho a la salud y la vida de soldado regular que sufrio una lesion producida por arma de fuego en combate con la guerrilla sin que la entidad le haya brindado asistencia medica alguna.
Solicita se ordene el tratamiento medico que requiere.
La accion de tutela como mecanismo constitucional que puede ser interpuesto en todo momento y por cualquier persona ante la amenaza o vulneración de sus derechos constitucionales fundamentales en procura de la proteccion inmediata de los mismos.
El elemento de inmediatez resulta imprescindible pues el transcurso del tiempo pone en evidencia la improcedencia de esta accion.
El accionante se desempeña como soldado activo y en tal virtud se encuentra afiliado al subsistema de salud de las fuerzas militares y por ello tiene derecho a recibir toda la atención medica que requiera.
