- Primero. REVOCAR la sentencia de instancia.
- Segundo. CONCÉDESE la tutela pedida por JORGE ENRIQUE DOMINGUEZ GUERRERO, cuya petición de sustitución pensional debe ser resuelta de fondo e íntegramente por la Subdirección de Prestaciones Económicas de CAJANAL dentro de las cuarenta y ocho (48) horas siguientes a la notificación de este fallo.
- Tercero. SE COMPULSAN copias a la Procuraduría General de la Nación para lo de su cargo, en relación con la responsabilidad disciplinaria de los servidores públicos que han ocasionado la mora en la respuesta al peticionario, desfigurando los alcances y el sentido del artículo 6 del Código Contencioso Administrativo.
- Cuarto. DESE aplicación al artículo 36 del Decreto 2591 de 1991.
