- Primero. REVOCAR el fallo del 8 de septiembre de 1999, proferido por el Juzgado Once Laboral del Circuito de Santa Fe de Bogotá, por medio del cual se negó la protección solicitada. En su lugar, se concede la tutela de los derechos invocados. En consecuencia, se ORDENA a la Superintendencia de Sociedades que verifique el cumplimiento estricto de los términos legales en el trámite liquidatorio así como la exacta observancia de la normatividad vigente sobre prelación legal de los créditos laborales.
- En todo caso, dentro de las cuarenta y ocho (48) horas siguientes al recibo por la empresa en liquidación de los recursos provenientes de la realización del activo del cual dispone, deberá el liquidador pagar en su totalidad las mesadas que adeuda al actor, y hacer las provisiones necesarias para seguirle pagando puntualmente.
- Segundo. DESE cumplimiento a lo previsto en el artículo 36 del Decreto 2591 de 1991.
