- en nombre del Pueblo y por mandato de la Constitución,
- R E S U E L V E :
- Primero. Revocar la sentencia proferida por el Juzgado
- Segundo. Civil del Circuito de Pasto, el 14 de septiembre de 1994 en todas sus partes.
- Segundo. Tutelar el derecho al debido proceso de la demandante Juana Carlota Fuertes Jácome, frente al Fondo Prestacional del Magisterio y Empleados de la Educación de Nariño, para lo cual se ordena a la Doctora Lucía del Socorro Basante de Oliva, en su condición de Gerente del Fondo Prestacional del Magisterio, que, en un término no superior a treinta (30) días a la notificación de esta providencia, disponga lo necesario para que la actora sea sometida a una cirugía de implantación de prótesis de cadera, incluyendo los gastos que ocasione la intervención, el valor y suministro de la prótesis y el tratamiento pos-operatorio de rehabilitación.
- Tercero. Comuníquese el presente fallo al Juzgado
- Tercero. Civil Municipal de Pasto, para los efectos del artículo 36 del Decreto 2591 de 1991.
