  1. Primero. Modificar la sentencia proferida por el Juzgado
  2. Cuarto. Penal Municipal de Ibagué el 13 de agosto de 2002 y la sentencia proferida por el Juzgado
  3. Segundo. Penal de Circuito de esa ciudad el 23 de septiembre de 2003.
  4. Segundo. Tutelar los derechos fundamentales a la salud y a la vida de Lina María Restrepo Viña. Ordenarle a CAFESALUD EPS que en el término de dos días autorice la realización del trasplante reno-pancreático requerido por aquella.
  5. Tercero. Disponer que a CAFESALUD EPS le asiste el derecho de repetir contra el Fondo de Solidaridad y Garantía, subcuenta de compensaciones del régimen contributivo, aquellos gastos adicionales en que incurra con ocasión de los procedimientos, exámenes, medicamentos o insumos excluidos del POS que le sean realizados o entregados a la actora.
  6. Cuarto. DÉSE cumplimiento a lo dispuesto en el artículo 36 del Decreto 2591 de 1991.
