- en nombre del pueblo y por mandato de la Constitucion,
- R E S U E L V E:
- Primero. REVOCAR la sentencia proferida por la Sala Penal del Tribunal Superior del Distrito Judicial de San Gil (S.), el 19 de marzo de 2002, para negar la accion de tutela instaurada por Maurilia Sanchez de Garcia y Ana Belen Sanchez Suarez contra el Juzgado
- Segundo. Promiscuo de Familia de la misma ciudad, para, en su lugar, restablecer la garantia constitucional de las accionantes al debido proceso.
- En consecuencia ORDENAR i) al Juez
- Primero. Promiscuo de Familia de San Gil a) dejar sin valor ni efecto el Oficio 103 del 4 de marzo de 1999, emitido dentro del Proceso de Jurisdiccion Voluntaria de Alicenia Sanchez Suarez, y b) comunicar su decision al Registrador Municipal del Estado Civil del Valle de San Jose (Santander) para que proceda de igual manera, respecto del Registro Civil de Defuncion serial 23266564 extendido el 15 de marzo de 1999, y ii) al Juez
- Segundo. Promiscuo de Familia de San Gil invalidar todo lo actuado en el Proceso de Sucesion de Alicenia Sanchez Suarez.
- En uno y en otro caso hasta tanto se publique la sentencia que declaro la muerte de la senora Sanchez Suarez en la forma dispuesta en el numeral 5deg del articulo 657 del Codigo de Procedimiento Civil.
- Segundo. Por Secretaria librese la comunicacion prevista en el articulo 36 del Decreto 2591 de 1991.
