- Primero. REVOCAR los fallos proferidos por el Juzgado
- Segundo.
- Primero. Civil del Circuito de Santa Marta, mediante las cuales se negó la protección de los derechos invocados por los accionantes. En consecuencia, se concede la tutela pedida por Franklin Antonio Gómez Bermúdez y Carlos Caballero Zambrano.
- Segundo. SE ORDENA al Gobernador del Departamento del Magdalena que, dentro del término máximo de tres (3) meses, contados desde la notificación de la presente providencia, proceda a cancelar a los demandantes la totalidad de las mesadas adeudadas, con cargo al anticipo contemplado en el parágrafo 6 del artículo 2 de la Ley 549 de 1999.
- Tercero. Por Secretaría LÍBRESE la comunicación prevista en el artículo 36 del decreto 2591 de 1991.
