- Primero. REVOCAR el fallo proferido por la Corte Suprema de Justicia -Sala de Casación Laboral-, mediante la cual se negó la protección incoada por Moisés Hincapié González.
- Segundo. En su lugar, CONCEDER la protección solicitada y ORDENAR al Gobernador del Departamento del Magdalena que, si todavía no lo ha hecho, en el término de tres (3) meses, contados a partir de la notificación del presente fallo, proceda a cancelar las mesadas adeudadas, con cargo al anticipo contemplado en el parágrafo 6 del artículo 2 de la Ley 549 de 1999.
- Tercero. Por Secretaría, LÍBRESE la comunicación prevista en el artículo 36 del decreto 2591 de 1991.
