- Primero. REVOCASE la sentencia proferida por la Sala Civil - Familia, del Tribunal Superior del Distrito Judicial de Tunja, dentro de la accion de tutela instaurada por el senor Lucinio Bolivar Jimenez, contra la Caja de Prevision Social en liquidacion. En su lugar CONCEDASE el amparo solicitado.
- Segundo. ORDENASE al Gerente Liquidador de la Caja de Prevision Social, que en el termino maximo de un (1) mes, contado a partir de la notificacion de esta sentencia, expida las ordenes necesarias que autoricen la realizacion del procedimiento quirurgico requerido y posterior implantacion de protesis solicitada por el actor, sin perjuicio de que dicha entidad pueda repetir en contra del Fosyga, por el equivalente de la atencion prestada.
- Igualmente, la entidad demandada debera informar al peticionario, los tramites que deban adelantarse para que efectivamente se realice la practica de la cirugia y se entregue el aparato ortopedico prescrito.
- Tercero. Por Secretaria General, librense las comunicaciones de que trata el articulo 36 del decreto 2591 de 1991.
