Demanda de inconstitucionalidad contra el art. 6, numeral 8, 9 y 22 del Decreto 2453 de 1993, “por el cual se determina la estructura orgánica, objetivos, funciones y régimen de sanciones de la Superintendencia de Vigilancia y Seguridad Privada y se dictan otras disposiciones”.
El decreto objeto de revisión se expidió en ejercicio de las facultades extraordinarias conferidas por la Ley No. 62 de 1993, artículo 35, numeral 7.
El actor señaló que el presidente excedió sus facultades extraordinarias porque entregó al Superintendente de Vigilancia y Seguridad Privada la facultad de fijar las contribuciones que trata la Ley 62 de 1993, art. 34.
La Sala concluyó que operó la cosa juzgada constitucional, por lo que declaró estarse a lo resuelto en la Sentencia C-455/94, que declaró inexequible los apartes acusados.
