Demanda de inconstitucionalidad contra el art. 1 (parcial) de la Ley 445 de 1998, “por la cual se establecen unos incrementos especiales a las mesadas y se dictan otras disposiciones”.
El demandante señaló que el precepto acusado desconoce el derecho a la igualdad porque deja por fuera de estos beneficios a los pensionados por jubilación, invalidez, vejez y sobrevivientes del sector público del orden territorial y a los del sector privado.
La Corte evidenció que el asunto a revisar ya había sido objeto de estudio en la Sentencia C-067 de 1999, donde se declaró la exequibilidad condicionada del artículo.
