Solicitud de aclaración de la Sentencia C-540/23.
El memorialista le pidió a la Corporación aclarar de manera oficiosa el precitado fallo, en cuanto a que sus efectos no deben ser inmediatos y menos retroactivos para el período gravable 2023, pues no se puede revivir una norma con efectos retroactivos.
Por no cumplir con los requisitos de legitimación por activa, oportunidad y carga argumentativa, la Sala Plena de la Corporación decidió RECHAZAR, por improcedente, la aclaración invocada.
