La controversia entre los precitados despachos se basó en las diferentes interpretaciones del factor territorial.
Teniendo en cuenta que ambos despachos tienen competencia para dar trámite a la solicitud de amparo invocada, la Corte determinó que quien debe resolverla es el Juzgado Sexto Civil Municipal de Oralidad de Cúcuta, a donde se ordena remitir el expediente para que, de manera inmediata, profiera la decisión de fondo a que haya lugar.
