Recusación formulada en contra de la magistrada Paola Andrea Meneses Mosquera.
El memorialista, quien indicó actuar en calidad de representante legal de la Asociación Creative Bullets, la cual es titular de los derechos de la serie “Matarife”, adujo que el presidente Iván Duque Márquez tiene interés en el proceso y que magistrada mencionada tiene una amistad íntima con él, con lo cual se configura la causal de recusación prevista en el numeral 1º del artículo 56 del Código de Procedimiento Penal.
La Sala Plena de la Corporación RECHZÓ por improcedente la recusación invocada, debido a que: (i) en virtud de lo dispuesto en el artículo 39 del Decreto 2591 de 1991, en el trámite de tutela no es procedente la recusación, por tratarse de un trámite que debe ser célere y sumario; y (ii) la magistrada Meneses Mosquera no ha manifestado estar incursa en alguna de las causales de impedimento previstas en el artículo 56 del Código de Procedimiento Penal.

- PRIMERO. RECHAZAR POR IMPROCEDENTE la recusación presentada por Marcel Dousse contra la magistrada Paola Andrea Meneses Mosquera en el proceso de tutela T-7.927.186, en la acción de tutela presentada por Álvaro Uribe Vélez contra Daniel Mendoza Leal.
