Solicitud de nulidad de la Sentencia C-540/23.

El Ministerio de Hacienda y Crédito Público adujo que el precitado fallo incurrió en elusión arbitraria de asuntos de relevancia constitucional y en incongruencia entre las partes motiva y resolutiva.

Por no satisfacer la carga argumentativa necesaria para discutir la validez de sentencias proferidas por la Corte Constitucional en sede de control abstracto y revestidas de la fuerza de la cosa juzgada constitucional, la Sala Plena de la Corporación decidió RECHAZAR la nulidad deprecada.
