La Sala Plena de la Corporación encontró la precitada recusación es improcedente por no acreditar el requisito de oportunidad.
Ello, en tanto no se presentó con la demanda que suscribió, entendida como el momento procesal oportuno y, se interpuso en una fecha en la cual ya se había agotado la competencia del Ministerio Público con la presentación de su concepto.
Con base en lo anterior se dispuso el RECHAZO.
