El Jefe del Ministerio Público manifestó a la Corporación el impedimento que tendría para rendir el concepto en el asunto de la referencia, por haber conceptuado sobre la constitucionalidad de la normatividad cuya validez se debate en el proceso judicial.
La Sala Plena considera que como el Procurador fijó su posición en el debate propuesto en el proceso, pero que tal postura se sentó en el ejercicio de sus funciones constitucionales y legales, no debe aceptarse el impedimento formulado.
Se NIEGA.

- PRIMERO. NEGAR, por las razones expuestas en esta providencia, el impedimento manifestado por el Procurador General de la Nacion para emitir concepto dentro del expediente D-12821.
- SEGUNDO. De conformidad con lo dispuesto en el Decreto 262 del 2000 y en armonia con los Decretos 2067 de 1991 y 121 de 2017, ORDENAR a la Secretaria General de la Corte Constitucional que comunique al Procurador General de la Nacion la presente decision, para que rinda de inmediato el concepto de que tratan los articulos 242-2 y 278-5 de la Constitucion Politica.
