La controversia se fundó en las diferentes interpretaciones que del factor territorial hicieron las autoridades judiciales involucradas.
Teniendo en cuenta que ambos despachos son competentes para dar trámite a la acción de tutela, la Corte decide dar prevalencia a la elección que a prevención hizo la actora y dispone que sea el juzgado de Bogotá quien de manera inmediata, tramite y adopte la decisión de fondo a que haya lugar.
