Impedimento formulado por la Procuradora General de la Nación.
La Jefa del Ministerio Público manifestó estar incursa en la causal de impedimento consistente en “haber intervenido en la expedición de las disposiciones examinadas”, en razón a que durante su gestión como Ministra de Justicia y del Derecho remitió una intervención al Congreso de la República en la que manifestó la conveniencia de adoptar las normas que, a la postre, serían objetadas por el Presidente de la República y cuyo control corresponde a la Corte Constitucional con fundamento en el artículo 241-8 de la Carta Superior.
La Sala Plena de la Corporación encontró que la citada funcionaria efectivamente se encuentra incursa en una de las causales previstas en el artículo 25 del Decreto 2067 de 1991 y, por ello, ACEPTA su impedimento para emitir concepto y ordena que se corra traslado del presente proceso al Viceprocurador General de la Nación a efectos de que rinda el concepto al que aluden los artículos 242-2 y 278-5 de la Constitución.

- PRIMERO. Con base en las razones expresadas en esta providencia, ACEPTAR el impedimento manifestado por la Procuradora General de la Nación para emitir concepto dentro del expediente OG-165.
- SEGUNDO. ORDENAR a la Secretaría General de la Corporación que corra traslado del presente proceso al Viceprocurador General de la Nación a efectos de que rinda el concepto al que aluden los artículos 242.2 y 278.5 de la Constitución Política.
