Considera la Corte que quien debe resolver la acción de tutela formulada es el Tribunal Superior de Cundinamarca, por ser el despacho judicial elegido a prevención por el accionante y a quien fuere asignado el trámite en primer término.
Consecuentemente se remite el expediente a dicha Corporación, para que de manera inmediata tramite y adopte la decisión de fondo a que haya lugar.

- Primero. DEJAR SIN EFECTOS el auto del 29 de agosto de 2017 proferido por el Tribunal Superior de Cundinamarca, Sala Penal, mediante el cual se declaró sin competencia para conocer de la acción de tutela presentada por Juan Carlos Rodríguez Agudelo contra el Juzgado Penal del Circuito Especializado de Puerto Asís (Putumayo), el Juzgado
- Primero. Promiscuo del Circuito de Puerto Asís (Putumayo), la Secretaría Ejecutiva de la Jurisdicción Especial para la Paz y la Jefatura Jurídica del Ejército Nacional.
- Segundo. REMITIR el expediente ICC-3122 al Tribunal Superior de Cundinamarca, Sala Penal, que contiene la acción de tutela presentada por Juan Carlos Rodríguez Agudelo para que, de manera inmediata, tramite y adopte la decisión de fondo a que haya lugar.
- Tercero. Por la Secretaría General de la Corporación, COMUNICAR a las partes y al Tribunal Superior de Mocoa, Sala Única de Decisión, la decisión adoptada en esta providencia.
