Conflicto de competencia suscitado entre el Juzgado Tercero Promiscuo Municipal de Barbosa (Santander) y el Juzgado Primero Penal del Circuito de Vélez (Santander).
La controversia se generó por la interpretación de la normativa que establece las reglas de reparto.
La Corte considera que la autoridad competente para resolver la acción de tutela es la del municipio de Barbosa.
Consecuentemente con ello, decide enviarle el expediente para que de manera inmediata y sin dilaciones tramite y adopte la decisión de fondo a que haya lugar.
Se hace una advertencia a dicho juzgado para que en lo sucesivo se abstenga de proceder como lo hizo, en tanto ello se opone a la jurisprudencia reiterada y vinculante de la Corporación.

- PRIMERO. DEJAR SIN EFECTOS el auto proferido el 11 de agosto de 2017, por el Juzgado
- Tercero. Promiscuo Municipal de Barbosa -Santander, mediante el cual dicha autoridad judicial rechazó la competencia para conocer de la tutela interpuesta por el señor Mauricio Mateus Rodríguez.
- SEGUNDO. REMITIR el expediente ICC-3100 al Juzgado
- Tercero. Promiscuo Municipal de Barbosa -Santander, para que asuma de manera inmediata y sin dilaciones el conocimiento de la acción de tutela formulada por el señor Mauricio Mateus Rodríguez contra de la Agencia Nacional de Tierras.
