Conflicto de competencia suscitado entre el Tribunal Administrativo del Valle del Cauca y el Tribunal Superior del Distrito Judicial de Pereira, Sala Unitaria Civil.
La controversia entre las precitadas autoridades tuvo su origen en las diferentes interpretaciones del factor territorial.
Ambos despachos ´presentaron una serie de argumentos relacionados con el lugar donde se presentó y tuvo sus efectos la vulneración de derechos alegada por la parte demandante.
Se dirime el asunto con la remisión del expediente al Tribunal Administrativo del Valle del Cauca para que, de forma inmediata, continúe con el trámite respectivo y profiera la decisión que considere pertinente, conforme a las previsiones del artículo 86 de la Constitución y del Decreto estatutario 2591 de 1991.

- Primero. DEJAR SIN EFECTOS el auto proferido el 1 de febrero de 2024 por el Tribunal Administrativo del Valle del Cauca, en el marco del trámite de la acción de tutela promovida por el señor Oscar Fernando Quintero Mesa.
- Segundo. REMITIR el expediente ICC-4628 al Tribunal Administrativo del Valle del Cauca para que, de manera inmediata, tramite y adopte la decisión a que haya lugar.
- Cuarto. Por la Secretaría General de esta corporación, COMUNICAR la presente decisión a la parte demandante, al Tribunal Administrativo del Valle del Cauca y al Tribunal Superior del Distrito Judicial de Pereira, Sala Unitaria Civil.
