Conflicto de competencia suscitado entre el Juzgado Quinto Penal del Circuito de Neiva y el Juzgado Veintinueve Administrativo Oral del Circuito de Medellín.
La controversia entre los precitados despachos involucrados tuvo su origen en las diferentes interpretaciones del factor territorial.
Ambos despachos presentaron una serie de argumentos relacionados con el lugar donde se presentó y tuvo sus efectos la vulneración de derechos alegada por la parte demandante.
Teniendo en cuenta que ambos juzgados tienen competencia para resolver la acción de tutela planteada la Corte decidió, teniendo en cuenta el criterio a prevención, dar prevalencia la elección que hizo la parte accionante.
Con base en lo anterior ordenó enviar el expediente al Juzgado Quinto Penal del Circuito de Neiva, para que de forma inmediata inicie el trámite y profiera decisión de fondo a la que haya lugar, conforme a las previsiones del artículo 86 de la Constitución Política y del Decreto 2591 de 1991.
