Conflicto de competencia suscitado entre el Juzgado Cuarto Civil Municipal de Bogotá y el Juzgado Promiscuo Municipal de Tocancipá.
La controversia se generó por las diferentes interpretaciones que del factor territorial hicieron los despachos involucrados.
Considera la Corte que la autoridad llamada a pronunciarse respecto de la acción de tutela es el del municipio de Tocancipá, por cuanto allí es donde se produjo la vulneración de los derechos fundamentales invocados por el actor.
Se remite el expediente al Juzgado Promiscuo Municipal de esa entidad territorial, para que de manera inmediata tramite y adopte la decisión de fondo a que haya lugar.

- Primero. DEJAR SIN EFECTOS el auto del 8 de junio de 2018 proferido por el Juzgado Promiscuo Municipal de Tocancipa mediante el cual se declaro sin competencia para conocer de la accion de tutela presentada por el senor Ever Manuel Garcia Perez contra la empresa RECICLENE SA.
- Segundo. REMITIR el expediente ICC 3432 al Juzgado Promiscuo Municipal de Tocancipa, que contiene la accion de tutela presentada por el senor Ever Manuel Garcia Perez para que, de manera inmediata, tramite y adopte la decision de fondo a que haya lugar.
- Cuarto. Por la Secretaria General de la Corporacion, COMUNICAR a la parte actora y al Juzgado
- Cuarto. Civil Municipal de Bogota, la decision adoptada en esta providencia.
