Con el presente auto se declara la nulidad de todas las actuaciones surtidas en el proceso de tutela de la referencia, a partir del auto mediante el cual el Tribunal a quien fue asignado el asunto decidió abstenerse de resolver el recurso de amparo formulado.
Se ordena la remisión del expediente a dicha autoridad judicial para que de manera inmediata reinicie el proceso, integre debidamente el contradictorio y se pronuncie como juez constitucional de primera instancia.

- PRIMERO. DECLARAR la nulidad de todas las actuaciones surtidas en el proceso de tutela de la referencia desde el Auto del 16 de enero de 2017 proferido por Sala de Decision Civil - Familia - Laboral del Tribunal Superior del Distrito Judicial de San Gil.
- SEGUNDO. REMITIR el expediente de la referencia a la Sala de Decision Civil - Familia - Laboral del Tribunal Superior del Distrito Judicial de San Gil, para que, de manera inmediata, reinicie el proceso, integre debidamente el contradictorio y se pronuncie como juez constitucional de primera instancia de la accion de tutela interpuesta por Gildardo Franco Tirado contra el Juzgado
- Segundo. Promiscuo Municipal de Cimitarra y el Juzgado Promiscuo del Circuito de la misma municipalidad.
- TERCERO. ORDENAR que por Secretaria General se comunique la decision adoptada en esta providencia a las partes.
