Solicitud de nulidad del Auto 1123/21, mediante el cual se resolvió un recurso de súplica interpuesto dentro del trámite de la demanda de la referencia.
El peticionario adujo que se le violó su derecho al debido proceso, en tanto la providencia cuestionada confirmó la de rechazo con fundamento en la exigencia de requisitos no previstos en el régimen procedimental de los juicios y actuaciones que deben surtirse ante la Corte Constitucional.
La Sala Plena de la Corporación consideró que el peticionario no logró estructurar un cargo de nulidad que cumpliera la carga argumentativa que jurisprudencialmente se ha exigido, pues los motivos por los cuales se pretendió la nulidad, lejos de buscar remediar alguna vulneración concreta al debido proceso, pretendían reabrir el debate constitucional cerrado y, a partir de ello, buscó obtener una decisión que favoreciera sus intereses.
Con base en lo anterior se RECHAZA la nulidad incoada, por incumplir la exigencia de carga argumentativa.
