Conflicto de competencia suscitado entre el Tribunal Administrativo de Nariño y el Tribunal Superior de Pasto Sala Civil Familia.
Considera la Corte que el Tribunal Administrativo respetó y acató lo dispuesto en el artículo 32 del Decreto 2591 de 1991 y, que en dicho sentido, es la Sala Civil Familia del Tribunal Superior de Pasto quien debe resolver la impugnación formulada en contra de la sentencia de tutela proferida por el Juzgado Primero Civil del Circuito de dicha ciudad, en tanto es su superior jerárquico y funcional.
Se dispone enviar el expediente a dicha Corporación para que de manera inmediata asuma el conocimiento y profiera la decisión de segunda instancia que corresponda.

- PRIMERO. DEJAR SIN EFECTOS la providencia del 5 de julio de 2017, proferida por el Tribunal Superior del Distrito Judicial de Pasto, Sala Unitaria Civil -Familia, dentro del expediente de la acción de tutela promovida por el señor Carlos Alberto Narváez Melo, contra la Unidad Administrativa Especial Migración Colombia.
- SEGUNDO. REMITIR el expediente ICC-3037 al Tribunal Superior del Distrito Judicial de Pasto, Sala Unitaria Civil -Familia para que de manera inmediata asuma el conocimiento y resuelva la impugnación correspondiente.
- TERCERO. Por la Secretaría General de la Corte Constitucional, COMUNICAR la presente decisión a las partes, al Juzgado
- Primero. Civil del Circuito de Pasto y al Tribunal Administrativo de Nariño.
